TERMS OF USE
1. Acceptance of Terms of Use
By using the noblebonsai.com website (the “Website”), the “Noble Bonsai” mobile application (the “App”), or the “Noble” connected furniture (the “furniture”), you agree to be fully and unconditionally bound by these Terms of Use.
If you do not agree, you may not use our services or devices.
2. Changes to Features and Services
We reserve the right to modify, add or remove features of the Website, App and/or Unit at any time, without prior notice.
These changes may concern aesthetics, functionality or security.
3. Remote Access for Maintenance and Support
We reserve the right to remotely access the Unit at any time for maintenance, technical diagnostics, or software updates.
No remote commands will be issued without technical need or the user's consent, except in critical safety situations.
4. Environmental Conditions and Usage
The Noble Unit is designed for indoor use only, at ambient temperatures between 2°C and 35°C.
Outdoor use is permitted only if:

The Unit is fully protected from rain, snow, humidity, dust, and bad weather;

The power outlet is also shielded from moisture and splashing;

Air humidity does not exceed 80%.
We disclaim all liability for damage resulting from non-compliant usage.
5. Warranty and Repairs
The Unit is covered by a two (2) year warranty from the date of purchase against material or manufacturing defects.
The plant is not included under this warranty.
In case of a covered defect:

Defective parts must be shipped back to Noble Bonsai, in return, new parts will be shipped to you free of charge by Noble Bonsai;

The client must replace the part themselves using parts exclusively provided by Noble Bonsai;

Defective parts must be returned within two (2) months, at our expense;

If located within 150 km of Montreux (Switzerland), on-site service may be arranged;

Beyond that, the replacement must be done by the client with remote assistance;

The customer may resort to third-party intervention to carry out the repairs, but at their own expense and under their own responsibility.
6. Out-of-Warranty Repairs
Spare parts may be ordered directly from Noble Bonsai. Replacement instructions will be provided.
All costs are the responsibility of the client.
7. Unit Maintenance
The water tank should be emptied and replaced if the water has been stagnant for more than six (6) months.
Use only clean, filtered water.
8. Warranty Exclusion for Improper Handling
Any disassembly, modification, or repair carried out by unauthorized persons will immediately void the warranty.
9. Power Supply Requirements
The Unit must be plugged into an outlet compliant with CE or Swiss standards.
Use of adapters, converters, or unstable power sources is at the user's own risk.
We are not liable for damages caused by improper power supply.
10. Disclaimer – Bonsai Health
The Unit assists in the care of a bonsai but does not guarantee the plant’s health or growth.
The user remains responsible for light exposure, substrate, trimming, and location.
11. User Monitoring Obligation
Users are responsible for monitoring the Noble Bonsai app and responding to alerts or error messages.
Failure to do so may result in damage not covered by the warranty.
12. Limitation of Liability
We are not liable for indirect damages, plant degradation, or malfunctions due to misuse, lack of Wi-Fi, or failure to maintain the Unit.
13. Intellectual Property
All content on the Website, App, and Unit is protected by intellectual property rights.
Unauthorized reproduction or distribution is prohibited.
14. Software Updates
Updates may be pushed at any time to improve functionality, stability, or security.
15. Dispute Resolution
In the event of a dispute, please contact us at contact@noblebonsai.com for an amicable resolution.
If unresolved, the competent jurisdiction is the Canton of Vaud (Switzerland).
16. Changes to These Terms
These Terms may be updated at any time. Updates become effective upon publication.
